Please read the terms and conditions contained in this document carefully, since they govern your use of the JCAA’s websites and/or applications, and since your use of our websites and/or applications constitutes your acceptance of the terms and conditions set out herein.

Throughout our websites, the terms “we”, “us”, “our”, “JCAA” and “the Authority” refer to the Jamaica Civil Aviation Authority and any of its affiliated organisations as appropriate to the context. “You” refers to any person accessing and/or using our websites and/or applications.

 

Website Privacy Notice

Any personal information or material sent to or collected on our websites and/or applications are subject to the terms and conditions set out in the Privacy Notice located on our websites and/or applications.

 

Accuracy, Completeness and Timeliness of Information

Whilst the JCAA uses all reasonable attempts to ensure the accuracy and completeness of information on our websites and/or applications, we are not responsible if the information we make available on our websites and/or applications is not accurate or complete. Any reliance upon the material on our websites and/or applications shall be at your own risk and you agree that it is your responsibility to monitor any changes to the material and information contained on our websites and/or applications.

Any use of free online translation services is at your own risk. We are not responsible for any third party translations of our websites and/or applications.

 

Transmission

Any non-personal communication or material you transmit to our websites and/or applications by electronic mail or otherwise, including any data, questions, comments, suggestions or the like, is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post becomes and remain the property of the JCAA and may be used for any purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, the JCAA is free to use for any purposes whatsoever (including but not limited to the developing, advertising and marketing of services) any ideas, artwork, inventions, developments, suggestions or concepts contained in any communication you send to our websites and/or applications. Any such use is without compensation to the party submitting information. By submitting information, you are also warranting that you own the material/content submitted, that it is not defamatory, and that the JCAA’s use will not violate any third party’s rights or otherwise place the JCAA in breach of any applicable laws. The JCAA is however under no obligation to use the information submitted.

 

Intellectual Property Rights

All copyright, trademarks and other intellectual property rights in all text, images and other materials on our websites and/or applications are the property of the JCAA or are included with the permission of the relevant owner.

You are permitted to browse our websites and/or applications, reproduce extracts by way of printing, downloading to a hard disk or for the purposes of distribution to other individuals on the proviso that you keep intact all copyright and other proprietary notices and that it is used only for lawful and connected purposes. No reproduction of any part of our websites and/or applications may be sold or distributed for commercial gain nor shall it be modified or incorporated in any other work, publication or website without the JCAA’s prior written approval.

The trademarks, logos, characters and service marks (collectively “Trademarks”) displayed on our websites and/or applications belong to the JCAA and/or the Government of Jamaica. Nothing contained on our websites and/or applications should be construed as granting any license or right to use any Trademark displayed on our websites and/or applications. Your use/misuse of the Trademarks displayed on our websites and/or applications, or on any other content on our websites and/or applications, except as provided for in these terms and conditions, is strictly prohibited. You are also advised that the JCAA will vigorously enforce its intellectual property rights to the fullest extent permitted by law.

 

Links to Other Websites

The JCAA’s websites and/or applications may contain links to third party websites or services that are not owned or controlled by the JCAA. These links may take you outside of the JCAA’s network and systems and the JCAA accepts no responsibility for the content, accuracy or function of these other third party websites or services. The JCAA does not warrant the offerings of any of these entities/individuals or their websites and the links are provided in good faith and do not imply endorsement by the JCAA. You acknowledge and agree that the JCAA shall not be held responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third party websites or services. The JCAA highly recommends that you make yourself aware of and carefully read the legal and privacy notices of all other websites or services that you visit.

 

Warranties and Disclaimers

Your use of the JCAA’s websites and/or applications is at your own and exclusive risk.

 

Warranties

Our websites and/or applications are provided to you on an “As Is” and “As Available” basis and consequently, the JCAA gives no warranties of any kind, whether expressed, implied, statutory or otherwise including warranties or representations that material, information or content on our websites and/or applications will be complete, accurate, reliable, timely, non-infringing to third parties; that access to our websites and/or applications will be un-interrupted or error-free or free from viruses; that our websites and/or applications will be secure; and/or that any advice or opinion obtained from the JCAA through our websites and/or applications is accurate or to be relied upon; and any representations or warranties thereto are accordingly expressly disclaimed.

The JCAA reserves the right in its sole discretion to amend, restrict, suspend or terminate without notice, your access to and/or use of our websites and/or applications or any feature or part thereof at any time.

The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.

 

Liability

You agree that the JCAA and/or any other party involved in creating, producing or delivering our websites and/or applications on our behalf shall have no liability or any responsibility whatsoever for any direct, incidental, consequential, indirect, special or punitive damages, costs, losses or liabilities whatsoever and howsoever arising out of your access to, use, inability to use, change in content of our websites and/or applications or arising from any other website you access through a link from our websites and/or applications or to the extent permitted by applicable law, from any actions the JCAA takes or fails to take as a result of any electronic mail messages you send us.

You further agree that the JCAA and/or any other party involved in creating, producing or delivering our websites and/or applications shall have no responsibility to maintain the material and services made available on our websites and/or applications or to supply any corrections, updates, or releases in connection therewith. Any material on our websites and/or applications is subject to change without notice.

Further, you agree that the JCAA shall have no liability or any responsibility whatsoever for any loss suffered, caused by viruses that may infect your computer equipment or other property by reason of your use of, access to or downloading of any material from our websites and/or applications. If you choose to download material from our websites and/or applications you do so at your own risk.

To the maximum extent permitted by applicable law, you expressly waive all claims against the JCAA, its officers, directors, employees, agents as well as the Government of Jamaica that may arise from your use or access of our websites and/or applications and agree to hold us harmless for any direct, indirect, punitive, special, incidental or consequential damage, however arising (including Attorney’s fees and all related costs and expenses of litigation and arbitration or at trial or on appeal if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury, or property damage, even if the JCAA has been previously advised of the possibility of such damage. Except as prohibited by law, if there is liability found on the part of the JCAA, it shall be limited to the amount paid for the services and under no circumstances shall there be consequential or punitive damages.

 

Prohibited Activity

You may use the JCAA’s websites, applications and/or services only for lawful purposes and in accordance with these and any other applicable terms and conditions. You are prohibited from doing any act that the JCAA in its absolute discretion may deem to be inappropriate and/or would be deemed to be an unlawful act or is prohibited by any laws applicable to our websites and/or applications including but not limited to:

  • Any act that would constitute a breach of either the privacy (including uploading private information without the concerned individual’s consent) or any other legal rights of others;
  • Using our websites and/or applications to defame or libel the JCAA, its employees or other individuals or acting in such a way that brings the JCAA into disrepute;
  • Uploading files that contain viruses that may cause damage to the property of the JCAA or the property of others;
  • Posting or transmitting to our websites and/or applications any non-authorised material including but not limited to material that is in the JCAA’s opinion likely to cause annoyance, detrimental to or in violation of the JCAA, the Government of Jamaica or third party´s systems or network security, defamatory, racist, obscene, threatening, pornographic or otherwise unlawful;
  • Any act that violates any applicable national or international law or regulation;
  • Exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise;
  • Transmitting or procuring the sending of any advertising or promotional material including any “junk mail”, “chain letter”, “spam” or any other similar solicitation;
  • Impersonating or attempting to impersonate the JCAA, a JCAA employee, another user or any other person or entity;
  • Infringing the rights of others in any way that is illegal, threatening, fraudulent or harmful or in connection with any unlawful, illegal, fraudulent or harmful purpose of activity; and
  • Engaging in any other conduct that restricts or inhibits anyone’s use or enjoyment of the JCAA’s websites and/or applications and/or services or which, as determined by us, may harm or offend the JCAA or other users or expose the JCAA or them to liability.

 

Additionally, you agree not to:

  • Use our websites and/or applications in any manner that could disable, overburden, damage, or impair our websites and/or applications or services; or interfere with any other party’s use including their ability to engage in real time activities through our websites and/or applications.
  • Use any robot, spider, or other automatic device, process, or means to access our websites and/or applications for any purpose, including monitoring or copying any of the material.
  • Use any device, software, or routine that interferes with the proper working of our websites and/or applications.
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of our websites and/or applications, the server on which they are stored, or any server, computer, or database connected to our websites and/or applications or services.
  • Take any action that may damage or falsify the JCAA’s rating.
  • Otherwise attempt to interfere with the proper working of our websites and/or applications and/or services.

 

No use by Minors

The JCAA’s websites/applications are intended only for access and use by individuals who are at least eighteen (18) years old. By accessing or using our websites/applications, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all applicable terms and conditions.

 

Error Reporting and Feedback

You may provide us either directly at info@jcaa.gov.jm or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our websites and/or applications (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) the JCAA may have development ideas similar to the Feedback; (iii) the Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) the JCAA is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant the JCAA and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

 

Amendments to Terms

The JCAA may amend these terms and conditions at any time by posting the amended terms on our websites and/or applications. It is your responsibility to review these terms and conditions periodically.

Your continued use of our websites and/or applications after the posting of revised terms and conditions shall mean that you accept and agree to the changes. You are expected to check this page frequently, so you are aware of any changes, as they are binding on you.

By continuing to access or use our websites and/or applications after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our websites and/or applications.

 

Termination

The JCAA may terminate or suspend your account and bar access immediately, without prior notice or liability, under the JCAA’s sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these terms and conditions.

If you wish to terminate your account, you may simply discontinue using our websites and or applications.

All provisions of these terms and conditions which by their nature should survive termination shall survive termination, including without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

 

Jurisdiction and Governing Law

The JCAA makes no representations that the material and information on our websites and/or applications are appropriate or available in all locations or languages.

You and the JCAA agree that any dispute or claim arising from or pertaining to the use of our websites and/or applications shall be governed by Jamaican laws and shall be submitted to the exclusive jurisdiction of the courts of Jamaica.

The JCAA’s failure to enforce any right or provision of these terms and conditions shall not be considered a waiver of those rights. If any provision of these terms and conditions is held to be invalid or unenforceable by a court or other tribunal of competent jurisdiction for any reason, the remaining provisions shall remain in full force and effect.

These terms and conditions constitute the entire agreement between us regarding your use of our websites and/or applications and supersede and replace any prior agreements we might have had between us.

 

Acknowledgement

By using our websites and/or applications and any services offered thereon, you acknowledge that you have read these terms and conditions of use and agree to be bound by them.
